$700,000 Personal Injury Lawnmower Accident

Our client lived in an apartment building in Beloit, Wisconsin. She asked the employee maintenance worker if he could put air in her bicycle tire, but he wasn’t able to do so at the time. Two days later, she saw the worker mowing the lawn, so she went up to him to continue the discussion. The worker did not then turn off the engine or the lawnmower blades, and had the safety guard on the discharge chute retracted up. As she stepped closer, her foot went into the blades, causing severe cuts and amputations.

We argued that the safety guard on the discharge chute should never have been in the up position and that this was negligence, for which the apartment owner was liable.  The defense that that our client was negligence for putting her foot in the lawnmower blades.
